JCB Owner Terms and Conditions

1. Welcome, JCB Owner

These Terms and Conditions ("Terms") govern your participation as a JCB owner on the GURUOM Owner application ("App"), operated by Guru Dev Cortex ("Company," "we," "us," or "our"). By creating an account on the App, you agree to these Terms and conditions. If you do not agree, you must discontinue use of the App immediately.

2. Your Role on the Platform

You are an independent JCB owner operating your own business and shall not, under any circumstances, be construed as an employee, agent, or contractor of Guru Dev Cortex. Nothing contained in these Terms shall be interpreted as creating or implying an employment relationship, agency, partnership, or joint venture of any nature between you and the Company.

3. Onboarding — Document Requirements and Compliance

For the purpose of onboarding, the Company requires:

• A valid Aadhaar card for identity verification
• Your registered mobile number and a clear selfie photograph
• Details of at least one backhoe loader (JCB), including a valid Registration Certificate (RC Book), current and subsisting insurance documentation, and clear photographs of the machine

All documents submitted must be genuine, accurate, currently valid, and in full compliance with applicable law. It is your sole and continuing responsibility to ensure that all documentation remains updated at all times.

Submission of expired, falsified, forged, or fraudulent documents shall result in the immediate suspension and permanent termination of your account. Furthermore, the Company expressly reserves the right to report such conduct to the appropriate law enforcement authorities and initiate legal proceedings under applicable provisions of Indian law, including but not limited to the Information Technology Act, 2000, and the Indian Penal Code, as applicable. The Company shall bear no obligation to provide prior notice in such circumstances.

4. Your Team and Your Machine

Any individual you engage or bring to a job site is part of your independent business arrangement and bears no affiliation with Guru Dev Cortex. You are fully and solely responsible for the conduct, safety, legal qualifications, and actions of your team. Your JCB must at all times be legally registered, validly insured, and maintained in a safe and roadworthy operational condition.

5. Our Role and Responsibility

Guru Dev Cortex assumes responsibility solely for the operation of the platform and App-related technical support.

The Company is a connecting platform exclusively and shall bear no liability in respect of:

• Any damage caused by your machinery or team to property, infrastructure, or individuals
• Any accident or injury occurring during, after, or in connection with a job
• Disputes concerning work quality or outcomes
• Any legal or regulatory matter arising from the operation of machinery
• Third-party claims arising from your operations
• Any loss or damage to your own machinery

6. Accepting and Completing an Order

Upon accepting an Order, you commit to proceeding to the customer's site promptly and without undue delay. Your live location becomes visible to the customer from the moment of acceptance. Upon arrival at the designated site, you must enter the customer's four-digit secure code — work must not commence prior to this verification. The work session timer initiates automatically upon code entry, with session breaks and resumptions managed through the App. Upon conclusion of work, you must initiate a completion request within the App. Once the customer confirms completion, payment is received directly from the customer in person.

7. Payments — How It Works

Guru Dev Cortex does not collect, process, or hold any payment. You receive payment directly from the customer upon job completion. The total amount includes your work charge along with any applicable App usage charge.

8. Wallet

A charge is deducted from your in-App wallet upon the completion of each Order. Should your wallet balance fall below the minimum threshold, your account will be temporarily locked until the balance is restored. Applicable charge rates and minimum thresholds are visible within the App at all times. The wallet serves exclusively for the management of App-related charges and does not hold or reflect your earnings in any manner.

9. Going Online and Offline

You retain full and exclusive control over your availability on the platform. Your location is tracked solely while you are in an Online status within the App and ceases immediately upon going Offline or closing the App.

10. When We Can Help With a Dispute

The Company is in a position to assist with the following:

• Timing discrepancies within the work session report where both you and the customer are in mutual agreement that a correction is warranted
• Technical issues encountered within the App during the course of an active Order

The Company's ability to assist is limited strictly to Orders that remain active and ongoing at the time the concern is raised. Once the final work report has been generated and the Order is marked as complete, the Company's capacity to intervene in any dispute is expressly extinguished. Matters pertaining to property damage, work quality, team conduct, and payment remain exclusively between you and the customer.

11. Prohibited Conduct

The following are strictly prohibited:

• Submission of fraudulent, forged, or expired documents at any stage
• Falsification or manipulation of work session timings or the final work report
• Deployment of unregistered, uninsured, or mechanically unsafe machinery to any job site

Upon acceptance of an Order, the customer places reliance on your commitment. Withdrawal from an accepted Order must be limited to genuine and substantiated circumstances, and the Company's support team must be notified at the earliest possible opportunity. Repeated instances of non-attendance or withdrawal without reasonable cause will result in a formal account review and may lead to suspension or termination.

12. Suspension and Termination

The Company reserves the right to suspend or permanently terminate your account in the event of, including but not limited to: submission of fraudulent documentation, repeated non-fulfilment of accepted Orders, misconduct, manipulation of the work report, or any serious violation of these Terms. Where practicable, the Company will endeavour to communicate with you prior to taking such action, except in cases of fraud or serious misconduct where immediate action is warranted.

13. Limitation of Liability

To the fullest extent permissible under applicable law, Guru Dev Cortex shall not be liable for any indirect, incidental, special, or consequential damages arising from or in connection with the use of the App, the outcome of any Order, or the actions or omissions of customers or third parties.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts situated in Surat, Gujarat.
